These Terms and Conditions apply to all transactions though Arlington Watches. Please read them carefully before purchase. All statements, guarantees or warranties in our Terms and Conditions are in addition to and do not affect your statutory rights.

Arlington Watches may change these Terms and Conditions at any time. Any changes will take effect on the date they are posted onto the site. You will be asked to read and accept the Terms and Conditions each time you place an order, to make certain you are familiar with the most recent ones. By placing an order, the customer is deemed to have accepted these Terms and Conditions and will abide by them.

Limitation of Liability

Nothing in this Agreement shall affect the statutory rights of any consumer or exclude or restrict any liability for death or personal injury arising from the negligence or fraud of Arlington Watches.

By agreeing to these Terms and Conditions, you agree that Arlington Watches shall not be liable either in contract, tort, negligence, statutory duty or otherwise, for any direct loss or damage (including loss or damage which is reasonably foreseeable or occurs naturally in the course of things) resulting from any acts, omissions, failures or delays occurring on or in relation to those parts of the Internet not under Arlington Watches’ direct control including, without limitation, damage for loss of business, loss of sales, non-payment of sums due, loss of profits, business interruption, loss of reputation, loss of business information, or any other pecuniary loss (even where Arlington Watches has been advised of the possibility of such loss or damage).

Operation

All prices that are quoted are in £ Sterling, GBP. Arlington Watches operate below the VAT threshold and do not charge VAT, unless explicitly stated otherwise. Any additional delivery charges are clearly displayed before an order is submitted.

All brand names are trademarks of their respective companies.

Product images featured on the site are for guidance only and are not always an exact match of a product. Availability of a product cannot be guaranteed.

The placing of an order represents an offer to purchase the products indicated by the customer and is not binding on us until the order is accepted and despatched by us. If a product shown on the website is unavailable, incorrectly priced, or incorrectly described, Arlington Watches shall not be obliged to sell the product.

In the unlikely event that an incorrect price is shown on our website, Arlington Watches reserve the right to abstain from fulfilling the order at that price. You will be notified, at which point you will be informed of the correct price, and be given the choice to proceed with the order. No contract exists between the Customer and Arlington Watches for the sale of any goods or services until we have received and accepted your order and we have received payment in full (in cleared funds). Once we do so, there is a binding legal contract between us.

The goods displayed on our website are subject to availability. If on receipt of your order the goods you have ordered are not available in stock, we will inform you as soon as possible.

An acknowledgement of your order will be sent to you via e-mail when you place your order online, but acceptance of your offer to buy the Goods will not take place until payment is taken. It is at this point that a binding legal contract is created and any contract is subject to these Terms and Conditions.

You, as the customer, have the chance to change and amend any part of your order until we send you an e-mail confirming your order. Arlington Watches suggest that you print a hard copy of the order for future records.

Payment for goods must be received before an order is despatched. The accepted payment methods are credit/debit cards and PayPal as specified in the web shop.

Arlington Watches cannot be held responsible for delays caused by our carriers.

Warranty

Every pre-owned watch we sell comes with a 12-month warranty alongside any remaining manufacturer's warranty it may also have. Should your watch stop working properly through no fault of your own then we shall repair it free of charge for the duration of the warranty.

Please have realistic expectations regarding the accuracy of vintage mechanical wristwatches. They will tell you the time, yes, but not as accurate as your mobile phone or a modern quartz watch. Depending on how the watch is worn or at which angle it is sitting, gravity will affect the performance of the movement and an accuracy of within couple minutes or more per day should be expected.

Note that power reserve varies depending on watch brand and model. Manually wound watches need to be fully wound to tell the time accurately for the full duration of the power reserve, and stop ticking once the tension in the spring tension is exhausted. It then needs to be rewound. Automatic watches rely on the movement of the arm of the person wearing it. Unless the watch is worn and subject to natural movements, it will stop ticking once the power reserve is out.

Vintage watches should never be considered water proof. Please do not submerge in water any vintage watch you buy and take care to protect it from any source of moisture as it is likely to damage the watch and is not covered by the warranty. This also applies to so-called diving watches that we sell. They are not meant to be worn while scuba diving or not even in the shower or in rain.

Please note that the warranty covers manufacturing and mechanical defects only. Examples of faults not covered by the warranty are those caused by shock, moisture, over-winding, or not following the manufacturer’s recommendations.

The warranty does not apply to any defect in the goods arising from fair wear and tear, wilful damage, accident, negligence by you or any third party, use otherwise than as recommended by Arlington Watches or the manufacturer, failure to follow instructions from Arlington Watches, or any alteration or repair carried out without approval from Arlington Watches.

It is your own responsibility to know and follow the manufacturer’s recommendations, which typically include that the watch should only be set in a clock wise direction and if applicable that no complications including the day/date complications should be set while the hour hand is ‘between 9 and 3 o clock’.

Our warranty is subject to the same terms and conditions as the manufacturer warranty. The standard manufacturer warranty does not cover theft or loss of the watch. Normal wear-and-tear or damage caused to the watch by accidents or mishandling/mistreatment are also excluded, as well as damage caused to a watch due to submersion in water which is against the manufacturer's guidance. The warranty does not cover wear of the watch strap, case, or crystal.

Any modification of a watch by the addition or substitution of components by aftermarket products which have not been provided by the manufacturer will also invalidate the warranty. The use of aftermarket components can severely compromise the technical performance, reliability, and waterproofness of the watch.

Please note that the watch must be delivered to our London office and be adequately insured, both at your expense. The warranty is in addition to your statutory and common law rights.

Claims

No liability for any claim for damage or non-functionality shall be accepted unless Arlington Watches are notified in writing by the purchaser within 24 hours of delivery.

No liability for any claim for missing items such as manuals, etc. shall be accepted unless Arlington Watches are notified in writing by the purchaser promptly after delivery.

No liability for any claim will be accepted in the case of goods differing in quantity or descriptions from the particulars given on the delivery note, unless Arlington Watches are notified in writing by the purchaser promptly after delivery and the onus is on the purchaser to prove any shortage.

Consequential Loss

Arlington Watches is excluded from any liability to the purchaser for; losses that were not foreseeable to both parties when the contract was formed; losses that were not caused by any breach on the part of the supplier; business losses, and/or losses to non-consumers.

Law

If any part of these terms and condition shall be found to be unlawful it shall not affect the validity or enforceability of the remainder of the conditions. This contract is and shall be deemed to have been made in England and shall in all respects be governed by English Law.

Online Purchase

The purchaser is responsible for deciding on the suitability of the goods offered for any particular use and for the consequences arising from modification of the goods.

Goods are subject to availability; Arlington Watches will not be responsible for compensating the purchaser for any other losses, which may be suffered if we cannot supply the goods.

Any dates specified for the delivery of the goods are approximate only and Arlington Watches shall not be liable for any losses, costs, damages, charges or expenses caused by any delay for delivery of the goods where the delay has been caused by factor’s beyond the control of Arlinton Watches.

Any discount voucher codes are capped at £100, i.e. a discount voucher of 10% will only yield a maximum of £100 discount even if the price of the watch exceeds £1,000.00

Arlington Watches shall not be liable to any person for any loss or damage, which may arise from the use of any of the information contained in any of the materials on this site. Arlington Watches will only be liable for consequential losses within the contemplation of the parties.

Certain links in this site (typically a banner advert or icon) will lead to sites, which are not under the control of Arlington Watches. When you activate any of these you will leave the Arlington Watches site and Arlington Watches has no control over and will accept no responsibility or liability for the material on any site, which is not under the control of Arlington Watches.

All complaints are taken seriously and will be investigated as soon as they are brought to our notice. We will endeavour to rectify any problems as soon as possible.

Matters beyond our Reasonable Control

Arlington Watches shall not be held liable for any breach of this Agreement caused by circumstances out of its control including, but not limited to, Acts of God, fire, lightening, flood, or extremely severe weather, explosion, war, disorder, industrial disputes (whether or not involving our employees), acts or omissions of Internet services providers or acts of local or central Government or other competent authorities.
